Regular Meeting

7:00 P.M.

Present at the meeting were Tammy Wilhoit, Chris Kuhn, Holley Rose, Bill Roberts, Lynn Fledderman, Steve Wihoit, Tony Wood, Daniel Craig, Dale Gick, Matt Wirth, and Reyna Jackson.

Motion to waive the reading and adopt the pre-read minutes. Bill 1st, Holley 2nd

Opened bids for the sale of 117 Ripley Street: this real estate is being sold pursuant to I.C. 36-1-11-4, with the minimum bid to be accepted of $90,000. The property may not be sold to a person which is ineligible pursuant to I.C. 36-1-11-16 and an offer to purchase this real estate submitted by a trust must identify each beneficiary of the trust and settler empowered to revoke or modify the trust. Town reserves the right to reject all bids.

1 bid was received - Zachary Rios for $90,000. In the bid he stated that he would like to negotiate the 30 day timeline. Lynn suggested taking the bid under advisement to review.

Old business:

Lynn has prepared the contract for Rumpke trash service for the period of 3 years, beginning January 1, 2023 and ending December 31, 2025.

Motion was made to NOT proceed with litigation on the Rick and Shawna Bushhorn property on the advice of Special Counsel (Bradley Kage) for the following reasons:

Commonwealth Engineers – Project Update Memo: Dale Gick and Matt Wirth

Water Improvements Project – OCRA is funding the US 421 water line replacement project in the amount of $581,481. Preliminary layout of water main is being prepared. OCRA/SIRPC specific timelines for the entire project must be followed. Commonwealth will coordinate with Tony for a kickoff meeting in October to make sure everything is incorporated in the design. Tony talked to SIRPC, and the award letter has been received.

Upcoming Street Improvement Projects – the 2022 round 2 application was submitted in August. Notice of award is expected late October or beginning November. Commonwealth has started the survey.

CCG 2021-2 (2022) Update –

Box culvert on Eckert has been installed and the road reopened
Down to 3 catch basins to put in
Need to cut across Eckert
About 100 feet of pipe remaining to put in
Concrete done except on Eckert
Some base asphalt left
Anticipate milling the week of the 17th
Surfacing to be done once milling is done.
May be done with the project at the end of the month.

2022 Community Crossing Project claims:

Commonwealth Engineers - $31,985.09 for Resident Project Representative.

All Star Paving – Pay Application #5 for $71,617.42 with retainage of $3,769.33

Majestic Electric - $36,737.00 for labor and material for the 2022 street lighting with the Community Crossing Project.

Ripley County Area Plan commission held a public hearing for Travis Neal on October 4th for a zoning change that was done on the old Done Right Diesel property.  The Town was not notified that there was going to be a hearing or zoning change. Mr. Neal stated that the County voted that they are in favor of the change, from local business to general business.  He wants to add a body shop to that location. He wants to know what the next steps are to proceed. Council raised the concern if this zoning change would affect the new housing construction that Neal is planning.

Water Department - Tony stated the water department has 2 issues because of drought, they are not sustaining daily usage with pumping. We need to petition publicly to conserve water. We are using more than we are pumping.

Also there was a water hydrant that was hit at Primary Care and it has been fixed, meter has been changed at Case Makes, one more manual meter will need changed at the trailer park, and the domestic usage was not included in the water loss audit. Tony believes that accounts for 12% of the water loss.

Sewer Department - Tony stated a bar screen is out of service. They have a tank to haul out for fertilizer and the. PH level is dropping due to the drought. He and council member Bill Roberts will be attending an Alliance Conference next week.

Police Department - Daniel Craig stated that 3 applicants have completed the agility test. He will begin working on a grant for a new police vehicle.

Reyna Jackson was present and asked if anything was being done with Hometown Auto? Chris Kuhn stated that the process is moving forward. She has filed another complaint with the county over the other property that they are now storing on. She also asked when the Town would start picking up leaves, she was told we’ve already started. She stated when she got her leaves raked she would call us. Clerk-Treasurer stated there is no need to call because they make a loop around town and they will pick them up when they are in that area.
