Regular Meeting
Tuesday, November 19, 2019
7:00 P.M.

Present at the meeting were Tammy Wilhoit, Norman Kappes, David Bultman, Tony Wood, Will Wallace, Justin Batchelor, Kyle Negangard, David Fox, Doug Baldesarri, E. Riley Thomas, Misty Veerkamp, and neighbor.

Pledge of Allegiance.

Roll Call - Holley Rose was not present.

Old Business:

Lynn has been working on preparing a letter to the Ripley County Area Planning, Auditor, and Commissioners because she believes they are under the presumption that the Town has the power to enforce County Code. After she has reviewed their ordinances, she does not see that the Town has that power. She has placed a call to John Ertel, County attorney, and they will be looking into it further.

Ordinance 2019-11: updating the Anti-Drug and Alcohol Misuse Prevention Policy as a part of the U.S. Department of Transportation Pipeline & Hazardous Materials Safety Administration Regulations. This ordinance needs to comply with the PHMSA changes. Lynn said that it may overlap some items with the existing ordinance, but that is not a problem.

Introducing and 1st reading of Ordinance 2019-12: An Ordinance of the Town of Osgood prohibiting the operation of commercial vehicles on W. Ripley Street (Brick Street). The Town has incurred damage to the street and trees as a result of the operation of commercial vehicles on W. Ripley Street. The Town Council after careful consideration, desires to prohibit commercial vehicles on W. Ripley Street to ensure the safety of its residents and the integrity of its roads and other infrastructure and prevent the landscaping and green areas of the Town from being damaged. Alternative routes exist for commercial vehicles to traverse so that such prohibition will not eliminate all avenues of ingress and egress for properties affected by this ordinance.

Doug Baldessari from Baker Tilly (formerly Umbaugh & Assoc.) was present to discuss the possible savings the Town could receive with the Sewage Works Refunding Revenue Bonds of 1996. Right now interest rates are at 2.75% to 3%, however there are some pros and cons in receiving the savings. To use another debt service fund, there are costs associated with issuance and annual disclosure requirements which would eat up any savings we would have earned. Another option would be to see if a local bank would underwrite the funds, with no disclosure requirements. Doug suggests that we wait until after the first of the year to discuss it further and possibly talk with the local banks to see if they would be interested. There would be a possible savings of $5,000 per year over the life of the loan.

Southeastern Indiana Regional Planning Commission is requesting the Town to appoint our 2020 representative to their Board of Directors.

The Town’s health insurance will be going up 27% if we stick with the current plan. Don Leslie from Leslie and Associates met with the Clerk-Treasurer and he is recommending that we change policies to Lifestyle H.S.A. The new policy would only have a 6 ½% increase.

Water Department - Tony Wood stated they have been in a transitional period, making adjustments to the clarifiers due to colder weather, and dropping chemical feed. The compliance schedule is complete. Employees have been using lots of vacation days here at the end of the year, so they’ve been shuffling to cover shifts. There is currently a water leak in front of Bob’s Service Station. An old 2” stub is leaking and the Alliance helped locate the leak. Johannigman will be here tomorrow to help fix it. So far they have had 3 water leaks and a pump station down.

Sewer Department - Tony Wood stated they have no compliance issues. The sludge truck is done and they sold the old one for scrap.

Police Department - Will Wallace stated they had 118 calls: 26 traffic stops, 6 town ordinances/civil processes, 18 agency/citizen assists, 13 accidents/emergency service assists, and 55 criminal. He will be working with the Jay C Store to “Fill the Cruiser” on December 9th. Donations will be used for families in need.

Fire Department - Kyle Negangard stated they had 14 runs: 5 first response, 1 fire, 4 mutual aid fire, and 4 mutual aid EMS. They brought on 2 new cadets. Closed on new lease for truck and first payment will be due December 2020.

A resident was present stating that her neighbor threatened her daughter and they also inquired about vehicle registrations from Ohio. Marshall Wallace is presently looking into this matter.
