Regular Meeting
Tuesday, March 19, 2019
7:00 P.M.
Present at the meeting were Tammy Wilhoit, Norman Kappes, Holley Rose, David Bultman, Lynn Fledderman, Carole Michel, Justin Batchelor, Will Wallace, Tony Wood, Rachel Runge, Jay Hall, and Jason Smith.

Old Business:
Water and Sewer rate ordinance - Lynn has prepared a draft ordinance for Doug at Umbaugh to review.
Opened the public hearing and had the 2nd reading of Ordinance 2019-2: The Town has the need to increase trash rates due to the aggregate amount of the required fees must be sufficient to pay the cost of operation. In order to meet the statutory requirement to cover the cost of operation, the monthly rate must be increased to $9.21 per unit. Norman Kappes opened the floor and asked anyone if they had questions: Carole Michel wanted to know what that had to do with the water and sewer rates. Clerk-Treasurer explained that it was an increase in the trash charge only. Hearing was closed.

Osgood Fire Department submitted their monthly statistical report prior to the meeting: 3 first responder runs, 4 mutual aids, 1 motor vehicle accident, and 1 gas leak for a total of 9 runs. In town runs = 5, township = 2, and out of district = 2
Carole Michel was present and read information that she found from South Bend, Indiana concerning Litter Code and Abandoned Vehicle Violations. Her question was to Council, “Do we have a litter code for our township?” She stated that it’s a shame when citizen’s property value gets devalued due to the negligence of a neighboring property. It is also concerning when a neighboring property is so littered with trash that it becomes a health concern due to possible rat infestation and possible flammable materials. She would like to know if the ordinances can be put on the Town’s webpage and published in the newspaper so property owners can be reminded on their responsibilities. She recommends that the steps be outlined so people know how to address the situation. She also wanted to address abandoned vehicles and housing units. She submitted pictures to the Council that she had taken around her neighborhood that should be addressed.
Officer Wallace addressed Ms. Michel and informed her that the property she is speaking of has already been addressed. Officer Wallace has already spoken to the property owner and he is allowing them some time to get it cleaned up due to the recent death of one of the owners and the poor health condition of the other. They have a grandson who is trying to help get it cleaned up. Officer Wallace also explained that when it comes to abandoned vehicles, they have to follow Indiana Code.
Water / Sewer Departments - Tony Wood stated that there are no issues with compliance for either department. The pre-treatment report is due in April.
Police Department - Will Wallace gave Council his monthly statistical report: 53 traffic stops, 2 town ordinance/civil process, 16 agency assists, 6 accidents/emergency service assist, and 37 criminal calls/arrest warrants for a total of 114 calls.
