Regular Meeting
Tuesday, March 17, 2009
7:00 P.M.
Present at the meeting were Linda Krinop, DeDee Holliday, Norman Kappes, Tammy Wilhoit, Beth Rumsey, Ed Newman, Don Dunbar, Steve Wilhoit, Brenda Wetzler, Chris Lemen, John Hegge, Cindy Bowling, Tony Wood, Art Simon, Barbara Dilk and Scot Cunningham.

Motion was made to waive the reading and adopt the pre-read minutes. Norman 1st, DeDee 2nd

Mary Ann Gay presented ordinances.
1. Ordinance 2009-3: All trash containers placed on sidewalks, streets, alleyways for collection by the Town of Osgood’s refuse contractor, shall be removed from said sidewalks, streets, alleyways within twenty-four (24) hours of collection. Any person, who or business which is in violation will be fined $100 per occurrence.
Motion was made to approve Ordinance 2009-3. DeDee 1st, Norman 2nd

2. Ordinance 2009-4: Any person, resident, owner, who allows their dog, cat or other animal to run at large and not under restraint, shall be subject to a fine of $25 for the first occurrence, $50 for the second occurrence and $100 for the third occurrence. Animals found to be running at large and not under restraint shall be captured and impounded at any available animal shelter and there confined in a humane manner for a period of not less than 4 days or until such time as re-claimed by the owner. In the event such animal is not re-claimed, it will be given away or disposed of in a humane manner.

3. Ordinance 2009-5: Businesses which cease operation within the Town of Osgood often fail to remove their signage, which creates confusion and contributes to decay within a timely manner. Therefore, all businesses, establishments and organizations which cease to operate within the corporate limits of the Town of Osgood shall remove all posted signage for said businesses, establishments and organizations within thirty (30) days of cease of operation. All violators of this ordinance thereof shall be subject to a fine of $100 per day that said signage remains posted after thirty (30) days.

Council Members have been receiving complaints on people working on their cars in the street. Property owners are complaining because they are finding car parts in their yards and are unable to access their driveways. Town Attorney will draft an ordinance to address this issue.
An ordinance which will regulate garage and yard sales was presented. Council will table this ordinance until after further review.
Council has also been receiving complaints of a business owner placing items on the sidewalks restricting the use of the sidewalks. Clerk-Treasurer was requested to write a letter to the business owner.
Scot Cunningham with the Lions was present requesting to be at the stoplight on May 2nd. Motion was made to allow the Lions the date of May 2nd. Norman 1st, DeDee 2nd

Art Simon with the Knights of Columbus was present requesting to be at the stoplight on May 16th. Motion was made to allow the Knights of Columbus on May 16th. Norman 1st, DeDee 2nd

Cindy Bowling with the American Legion was present requesting to be at the stoplight on May 23rd. Motion was made to allow the American Legion on May 23rd. Norman 1st, DeDee 2nd

Ed Newman was present. He had no updates on the junk yard. There was not meeting this month.
Brenda Wetzler, Osgood’s Representative to the Ripley County Economic Development, was present and stated that the Town of Osgood Industrial Site has now been designated “Shovel Ready”. The process the State required and all the criteria have been met.
Sewer Department – Tony Wood reported everything was good.
Gas Department – Steve Wilhoit reported that Tim Kreutzjans has passed his Operator Qualifications for gas. He is now a Certified Operator.
Fire Department – Chris Lemen reported that this is Severe Weather Awareness week.
Police Department – Marshall Hegge stated that there could be some legislation at the state level on golf carts that may be looked at in July.
Releases of Liens were signed for 708 N. Buckeye and 405 Wilson Street.
