Regular Meeting
Tuesday, July 17, 2018
7:00 P.M.

Present at the meeting were Tammy Wilhoit, Tina Wallace, David Bultman, Will Wallace, Justin Batchelor, Norman Kappes, Holley Rose, Kyle Negangard, Steve Wilhoit and Lynn Fledderman.

Motion was made to waive the reading and adopt the pre-read minutes. David 1st, Holley 2nd

Old Business:

Lynn has prepared a Complaint for the Ripley County Circuit Court on the Charles Michael Hughes property. It will be filed tomorrow.

Lynn will check to see if the 3 Utility Liens have been released.

2nd reading of Ordinance 2018-6: An Ordinance establishing cut permits for public way and restoration of public way.

Motion was made for the final adoption of Ordinance 2018-6. Holley 1st, David 2nd

2nd reading of Ordinance 2018-7: An Ordinance establishing requirements for licensing of peddlers.

Introducing Ordinance 2018-8: An Ordinance amending Ordinance §51.04, the town has the need to update and increase certain fees pertaining to its water utilities. A public hearing will be held next month on August 21st at 7:00 P.M.

Introducing Ordinance 2018-9: An Ordinance amending Ordinance §52.21, the town has the need to update and increase certain fees pertaining to its gas utilities. A public hearing will be held next month on August 21st at 7:00 P.M.

Introducing Ordinance 2018-10: An Ordinance regulating fireworks. It has been determined that it is in the best interest of the town to regulate firework use. A 2nd reading will be done at next month’s meeting.

Motion was made to primarily adopt Ordinance 2018-10. David 1st, Holley 2nd

2017 S. Buckeye Street Sidewalk claims:

Johannigman Excavating – still have not received any notification that as-builts, final waiver of liens, and consent of surety have been received.

Commonwealth Engineers - $1,608.86 for Construction and Commissioning

Motion was made to approve Commonwealth’s claim for $1,608.86. Holley 1st, David 2nd

2018 S. Walnut Street claims:

Johannigman Excavating – Pay Request #2 for $168,865.70 with retainage of $8,887.67
(75% from State Funds and 25% from Reynolds Foundation)

Commonwealth Engineers - $4,035.42 for Construction/Commissioning and RPR (Reynolds)

Majestic Electric – Pay Request #1 for $84,183.00 for lighting (Reynolds). Did not see a place for Norman’s signature on pay claim.

Motion was made for Tammy to sign if needed. Holley 1st, Norman 2nd

Motion was made to approve Johannigman Excavating, Commonwealth Engineers and Majestic Electric claims contingent upon Reynolds Foundation approval. Holley 1st, David 2nd

Water Project claims:

USDA held Pay Request #7 from last month thinking that a contractor was going to turn in a pay request, they did not. This month’s pay request will still be #7, we will just add the additional invoices.

C&H/M Excavating Inc. – Pay Request #1 for $144,397.24 with retainage of $7,599.86

Commonwealth Engineers - $20,947.53 for Construction and RPR (from last month)
$29,235.95 for Construction, RPR and Tank Analysis

Motion was made to submit a Request for Funds No. 7 to USDA for $194,580.72. Holley 1st, David 2nd

Safe Passage Inc. provides Domestic and Sexual Violence support services in six Southeast Indiana counties, including the community of Osgood. In the past 21 years they have provided free services and helped over 12,000 victims including their children. They are requesting our help to continue to offer support to the neediest residents.

Motion was made to approve $500 to Safe Passage Inc. Holley 1st, David 2nd

Fire Department – Kyle Negangard gave Council his monthly statistical report: 13 first responder runs, 5 fire, 1 fire alarm, 2 motor vehicle accidents, 1 lift assist, 1 elevator alarm, 2 mutual aid and 1 standby, for a total of 26 runs. Last month Alex and Lindsey Brison resigned in good standings. New line officers were chosen: Captain – Chris Hankins, 1st Lt – David Fox, 2nd Lt – Brett Linville and 3rd Lt – Jon Phillips.

Street Department – Steve Wilhoit stated that Garret Mosier resigned last Friday due to surgery and college. He would like Council approval to hire Blake Feiss as a part-time high school student to fill Garret’s position. The Garbage contract is coming up in June of 2019, he would like to start looking into verbiage for a new contract now. The rate structure also needs to be reviewed since the pricing has gone up. Lynn will come up with some specification prior to seeking bids. Skid buildings were discussed and if there should be a limit to the number allowed on a property.

Motion was made to hire Blake Feiss at minimum wage. Holley 1st, David 2nd

Police Department – Will Wallace gave Council their monthly statistical report: 63 citations/warnings, 5 ordinance violations, 9 agency/citizen assists, 4 accident/emergency service assist and 34 criminal calls for a total of 115 calls. He also wanted to commend Justin Batchelor for hitting the ground running since completing the academy. Holley Rose wanted to thank the Police Department for helping the Ripley County Health Department.

Lynn stated she will send Contel an affidavit concerning the Walnut Street easement.

Steve asked Lynn if she could prepare an easement for a wall at 212 S. Walnut.
