Regular Meeting

Present at the meeting were Tammy Wilhoit, DeDee Holliday, Linda Krinop, Mary Ann Gay, Beth Rumsey, Steve Linville, Norris Krall, Doug Baldesari, Christina Horan, Darlene Volk, Gerry Harmeyer, Bart Hicks, Brain Daeger, Steven Stepleton, and Eric Roush.

Roll Call – Norman Kappes was not present

Motion was made to waive the reading and adopt the pre-read minutes. DeDee 1st, Linda 2nd

Proof of publication and affidavit of posting and mailing of the notice of the public hearing on the rate ordinance were found to be in order.

Motion was made that Ordinance 2010-4 Establishing Rates and Charges for the Water Utility be read a second time. DeDee 1st, Linda 2nd

Opened public hearing for Ordinance 2010-4, Establishing Rates and Charges for the Water Utility. Linda Krinop stated the plant was built in 1979 and in order to stay in compliance with IDEM there would have to be updates made. The Town has done rate studies, engineering studies, and has looked at other avenues to make sure that this is the best route for our customers. We looked at purchasing water from Hoosier Hills Water, but we would have had to raise our rates 164% and that was just not feasible. This Ordinance would increase our rates 23%. Currently for 4,000 gallons the charge is $18.72, with the new rate it would go to $23.04. That is a $4.32 increase on an average household. We are getting a loan from Rural Development in the amount of $2,500,000 at a low interest rate of 3% and $778,000 in grant money. The Council feels that they have visited every option available to best meet the needs of our customers.

Umbaugh & Associates, Christina Horan, stated that the total project is $3,483,000. The Town will be receiving a Rural Development Bond issue for 40 years and will be applying $205,000 to the project, which would be less of an impact on the customers. Umbaugh looks at several requirements when calculating rates; operation expenses, debt service reserve, and maintenance. She handed out copies of a rate comparison graph to the public comparing our rates to other communities.

Linda Krinop asked if anyone had questions. Norris Krall asked if there was a contract with Holton. Mary Ann Gay stated that there was not a contract with Holton; they are looking for another source. Also, the Town of Versailles will be raising their rates and our rates will be $1.50 cheaper per 1,000 gallons than theirs. No further questions were asked.

Closed hearing.

After hearing all persons wanting to be heard on said Ordinance 2010-4, Council is now ready to for the Ordinance to be read the third time.

Motion was made for the third reading, Ordinance 2010-4 Establishing Rates and Charges for the Water Utility. DeDee 1st, Linda 2nd

Motion was made to adopt Ordinance 2010-4. DeDee 1st, Linda 2nd

Ordinance 2010-4 has been duly passed and adopted.

Motion was made to sign Loan and Grant Agreements with Rural Development and to adopt Resolutions. DeDee 1st, Linda 2nd

Notice of Award and Agreement for Division A with Mitchell and Stark Construction Company were presented.

Motion was made to sign and approve Notice of Award and Agreement with Mitchell and Stark. DeDee 1st, Linda 2nd

Notice of Award and Agreement for Division B with Holman Excavating was presented.

Motion was made to read bond Ordinance “An Ordinance concerning the construction of improvement, additions and extensions to the waterworks of the Town of Osgood, Indiana, the issuance of revenue bonds to apply on the cost thereof, the collection, segregation and distribution of the revenue of said works, the safeguarding of the interests of the owners of said revenue bonds, other matters connected therewith, including the issuance of notes in anticipation of bonds, and repealing ordinances inconsistent herewith” was prepared by Ice Miller. DeDee 1st, Linda 2nd

Motion was made to number the Ordinance 2010-5 and to be read a second time by title. DeDee 1st, Linda 2nd

Ordinance 2010-5 was then read a second time by title and no amendments were offered.

Motion was made that any applicable local rules be suspended and that unanimous consent of the members present be given for consideration of Ordinance 2010-5 was introduced on this day and for a third reading of Ordinance 2010-5 at this meeting without further consideration. DeDee 1st, Linda 2nd

Ordinance 2010-5 was read a third time by title.

Motion was then made that Ordinance 2010-5 be adopted as read. Linda 1st, DeDee 2nd

Linda announced that with two-thirds of the members elect of the Council present at the meeting and the motion for adoption having been carried by a two-thirds vote of all such elected members, Ordinance 2010-5 had been duly passed and adopted.

Organizational meeting will be held January 4, 2011 at 6:00 P.M.

Mary Ann will have the ordinance for K2 and spice ready for next meeting.

Motion was made to make retroactive to December 3, 2010 the hiring of John Wagner for a part-time position. DeDee 1st, Linda 2nd

Motion was made to reappoint Tammy Wilhoit as representative to the Southeastern Indiana Regional Planning Commission Board of Directors. DeDee 1st, Linda 2nd

2 – ayes

Motion was made to appoint Scott Rinear to be Osgood’s representative to the Ripley County Area Planning Commission. DeDee 1st, Linda 2nd

2 – ayes

Police Department – Steven Stepleton stood and gave a report on the cases that they have been dealing with; criminal, burglary, batteries, vandalism, crashes, and disorderly conduct cases.

Fire Department – Steve Linville stated they had their elections and all the positions stayed the same except for one new director, Steven Stepleton.

Motion was made to approve Umbaugh’s claim in the amount of $37,200. DeDee 1st, Linda 2nd

Motion was made to approve the budget for Rural Development. DeDee 1st, Linda 2nd
